2. Definitions
- Operator (“we”): the entity identified in section 1.
- User (“you”): the person who has created an account or uses the service.
- Service: the “PastierAI” web application including the voice agent, the text conversation and document uploads.
- Digital model: the software model built on Michal Pastier's publicly published work, which generates the answers.
- Output: text or audio the service generates in response to your input.
- Your content: everything you put into the service: questions, messages, voice and uploaded documents.
3. What the service is and is not
The service is a digital model built on Michal Pastier's publicly published work. It lets you hold a voice or text conversation with it and upload a document, which it then goes through and discusses with you.
You are not communicating with Michal Pastier in person. The outputs are a machine synthesis of his published work, not his live statement, position or recommendation. Michal Pastier is not responsible for the content of any particular answer and is not a party to this relationship.
In line with Art. 50 of Regulation (EU) 2024/1689 on artificial intelligence we expressly inform you that you are interacting with an artificial intelligence system. We also state this directly in the interface of the service.
Outputs are generated automatically and may contain inaccuracies, incomplete or incorrect statements. We do not warrant their correctness, completeness or fitness for any particular purpose. Verify important facts before relying on them.
4. No professional advice
The content of the service is informational and inspirational. It is not legal, tax, accounting, financial, investment or medical advice and it does not replace a consultation with a qualified professional.
You make business and other decisions at your own responsibility. The relationship between you and us is not one of client and adviser.
5. Account and registration
You need an account to start a conversation. The contract between you and us is formed on completion of registration, that is by submitting the registration form or signing in with a Google account.
How you can register
- With a company e-mail via Google. Google sign-in is reserved for company e-mail addresses. Addresses on free mail services (Gmail, Zoznam, Seznam, Outlook and the like) will not pass this way.
- By standard registration. You fill in a company name, e-mail and password. This route is open to everyone, personal e-mail addresses included.
This split is our access setting, not an assessment of your person. An alternative route is always available.
Your obligations
- to give true and current details,
- to protect your password and not share it with anyone,
- to notify us without undue delay if you suspect your account has been misused.
The account is personal and non-transferable. You are responsible for everything that happens through your account, except where the misuse was demonstrably caused by us. We do not accept disposable e-mail inboxes.
6. Trial run
The service is in a trial run. This is one limited period shared by all users, not an individual trial counted from your registration. During it, use is free of charge and without a payment card.
We may extend, shorten or end the trial run at any time. We will notify you by e-mail at least 14 days in advance of its end and of what follows. Limits or fees may apply afterwards, but we will never charge you anything without your prior express agreement.
Because this is a trial run, the service may be unavailable, may change or may contain errors. We give no warranty of availability or service level.
7. Recording and monitoring
Calls and messages are recorded, transcribed, and monitored where necessary for the performance of the service and on the basis of our legitimate interest in service quality and security, in full compliance with GDPR. We give notice of this on the page before a call starts. By using the service you acknowledge this processing.
Detailed information regarding the applicable lawful bases, processing purposes, user rights, and retention periods is set out in our Privacy Policy.
Do not put sensitive personal data, login credentials, payment information or confidential third party information into the conversation.
8. Your content
Your content remains yours. We claim no ownership over your inputs or uploaded documents.
By placing content into the service, you grant us a non-exclusive, royalty-free, worldwide licence to use, process, host, and reproduce it solely to the extent necessary to operate and deliver the service (including processing your questions, generating outputs, and fulfilling legal obligations). This includes the right to sublicense your content to our sub-processors and infrastructure partners strictly as needed for technical execution of the service. The licence is limited in duration to the retention periods specified in our Privacy Policy and does not grant any right to publish your content publicly or share it with third parties for their own independent purposes.
By providing content to the service, you represent and warrant that:
- you possess all necessary rights and authorisations to submit the content and grant the rights set forth herein,
- the use of your content within the service does not violate applicable law or infringe third-party rights, including copyrights, trade secrets, or privacy rights,
- where the content contains other people's personal data, you have a legal basis for its processing.
Data Processing Agreement (B2B): Where you use the service as a business user (B2B) and process or submit personal data of third parties through the service, such processing is governed by our Data Processing Agreement (DPA), which forms an integral part of these Terms of Use. By accepting these Terms of Use or using the service, you and we enter into and accept the DPA pursuant to Article 28 of the GDPR.
You agree to indemnify and hold us harmless from and against any third-party claims, liabilities, losses, damages, or reasonable expenses (including legal fees) arising out of or related to a breach of these representations or the unlawful provision of content to the service.
9. Prohibited use
You must not use the service to:
- circumvent limits, scrape automatically, query in bulk or overload the service,
- attempt to breach security, obtain other people's data or access parts of the service that are not yours,
- present outputs as Michal Pastier's personal statements,
- create the misleading impression of his consent, endorsement or cooperation,
- reverse engineer, copy or train competing models from the outputs of the service,
- pursue any unlawful, deceptive, abusive or otherwise harmful purpose,
- upload content that infringes the rights of third parties or the law.
In the event of a breach we may restrict or terminate access, without prior warning where the breach threatens immediate harm.
10. Availability and changes
We do our best to keep the service running reliably, but we do not guarantee uninterrupted availability. Operation may be interrupted by maintenance, technical failure or an outage at one of the providers we use.
We may change, add to or remove features of the service. Where this would materially reduce its scope, we will notify you in advance under section 16.
11. Intellectual property and outputs
Our rights
The service, its interface, graphics, texts, source code and the digital model are protected by copyright and other laws. They belong to the operator or to those who licensed them to it. Using the service gives you no rights to them beyond these terms.
Rights to Michal Pastier's original work, to his name, likeness and voice remain unaffected and are used by the Operator based on a valid license agreement.
Outputs
Outputs generated from your inputs may be used for your own purposes, including commercial ones, subject to the limits in section 9.
Bear in mind that outputs are generated automatically and another user may receive the same or a similar output. We do not warrant their uniqueness, nor that using them will not infringe third party rights. Verify that yourself.
12. Liability
Nothing in these terms limits or excludes our statutory liability that cannot be limited or excluded under mandatory provisions of Czech law, including liability for damage caused intentionally or by gross negligence, or for injury to human life or health.
Otherwise, to the extent permitted by the law of the Czech Republic:
- we are not liable for damage arising from reliance on the content of outputs,
- we are not liable for lost profit, loss of data, loss of business opportunity, or for indirect and consequential damage,
- we are not liable for unavailability of the service or for outages at infrastructure providers,
- we are not liable for content you place into the service.
For business users (B2B): During the free trial run our overall liability is limited to the broadest extent the law of the Czech Republic permits, as we provide the service free of charge. Should it become a paid service in future, total compensation is limited to the amount you paid for the service in the 12 months preceding the damage.
For consumers (B2C): The limitations of liability and damages under this section apply strictly to the extent permitted by mandatory provisions of Czech law (in particular the Czech Civil Code and the Czech Consumer Protection Act). Your statutory rights under Czech law are not affected.
13. Term and termination
The contract is concluded for an indefinite period. You may end it at any time by having your account deleted. Just write to assistant@fameplay.ai.
We may terminate the contract with 14 days' notice served by e-mail. Without notice, we may end access in the event of a material breach of these terms, in particular under section 9.
On termination your access to the service ends. We handle your data according to the periods set out in the Privacy policy. The provisions on intellectual property, liability and governing law survive termination.
14. If you are a consumer
The service is intended primarily for businesses, and registration asks for a company name. If you nevertheless use it outside your business activity, you are a consumer under Czech law and the following statutory consumer rights apply to you.
Withdrawal from the contract
If you are a consumer, you have the right to withdraw from the contract within 14 days of its conclusion without giving any reason. However, for digital content or services provided online, if you request that the provision of the service begin prior to the expiration of the 14-day withdrawal period, you must grant your express prior request and explicit acknowledgment that by commencing performance during the withdrawal period, you lose your statutory right of withdrawal once the performance has commenced or been fully delivered in accordance with Czech consumer protection law.
By registering and starting the service, you grant this express consent. You acknowledge that as a result, you lose your right of withdrawal once the service has been fully provided, or to the extent of its commenced performance during the free trial run.
Complaints and out-of-court dispute resolution
Send any complaint to assistant@fameplay.ai. We will handle it within 30 days of receipt.
If you are not satisfied with the outcome, you have the right to ask us for redress. If we reject the request or fail to answer within 30 days, you may file a proposal for out-of-court dispute resolution (ADR) with the Czech Trade Inspection Authority (ČOI), ADR Department, Štěpánská 567/15, 120 00 Praha 2, web: adr.coi.cz.
15. Governing law and disputes
This relationship is governed by the law of the Czech Republic, excluding its conflict-of-law rules. If you are a consumer, this does not deprive you of the protection afforded by the mandatory rules of the country of your habitual residence.
We will resolve disputes primarily by agreement. Failing that, the courts of the Czech Republic have jurisdiction. If you are a consumer, you may bring proceedings before the court of your place of residence.
16. Changes to these terms
We may update these terms, for example when the features of the service or the law change. The current wording is always the one published at this address; the effective date and version number are stated at the top.
We will notify you of material changes by e-mail or in the service at least 15 days in advance. If you are a consumer and do not agree with a change, you have the right to terminate the contract and reject the change under section 13 before it takes effect without any penalty. By continuing to use the service after the effective date you accept the change.
17. Final provisions
If any provision of these terms proves invalid or unenforceable, the remaining provisions stay in force. The invalid provision will be replaced by one that comes closest to its original meaning.
Our failure to exercise a right does not mean we have waived it. We may transfer our rights and obligations under this contract to a third party in the event of a transfer of the operation of the service; we will notify you of such a transfer in advance.
The Privacy policy and the Data Processing Agreement (DPA) form an integral part of these terms.
These terms are provided in Slovak and English languages; the Slovak version prevails. The legal relationship is strictly governed by the law of the Czech Republic.
